Who We Are

HyperFokus is a cloud-based ADHD productivity app developed and operated by HyperPlanners, based in Morocco.

1. Agreement to These Terms

By creating an account or using HyperFokus, you agree to these Terms of Service. If you do not agree, do not use the app.

2. Eligibility

You must be at least 13 years old to use HyperFokus. By using the app, you confirm that you meet this requirement.

3. Your Account

You are responsible for keeping your login credentials secure and for all activity that occurs under your account. You can delete your account at any time from More > Settings > Privacy & Account > Delete Account.

4. Acceptable Use

You agree to use HyperFokus only for lawful purposes. You may not attempt to gain unauthorized access to our systems, reverse engineer the app, or use automated scripts to access the service.

5. Subscriptions and Payments

5.1 Free Tier

HyperFokus offers a free tier with limited features including 3 Kip AI chats per day. No payment is required.

Premium features are available through a paid subscription or one-time purchase:

All Pro subscriptions and purchases are processed by Gumroad at hyperplanners.gumroad.com. HyperFokus is a free app on Google Play. No payments are made through Google Play or any app store. We do not store your payment card details. Payment processing is subject to Gumroad’s Privacy Policy and terms.

5.4 Renewals

Monthly and yearly subscriptions renew automatically until cancelled. You can cancel at any time through your Gumroad account at app.gumroad.com/library.

5.5 Refunds

Due to the digital nature of our product, we generally do not offer refunds. However, if you experience a technical issue that prevents you from using the app, contact us at support@hyperplanners.com within 7 days of purchase and we will review your case.

5.6 Lifetime Access

The Lifetime plan grants access to Pro features for as long as HyperFokus operates. In the unlikely event that HyperFokus is discontinued, we will provide at least 90 days notice to Lifetime users.

6. Kip AI

Kip is an AI companion powered by Anthropic’s Claude AI. Kip responses are AI-generated and may not always be accurate. Kip is not a substitute for professional mental health or medical advice. Daily chat limits apply based on your subscription plan.

7. Your Content

You own all content you create in HyperFokus. By using the app, you grant HyperPlanners a limited license to store and process your content solely to provide the service. We do not use your content for marketing or AI training.

8. Intellectual Property

HyperFokus, including its design, logo, branding, and code, is the intellectual property of HyperPlanners and is protected by copyright law. You may not copy, modify, or distribute it without written permission.

9. Third-Party Services

• Google Firebase — Authentication and data storage
• Anthropic Claude API — Kip AI conversations
• Gumroad — Payment processing
• Vercel — App hosting and serverless functions

10. Availability and Changes

We aim to keep HyperFokus available at all times but do not guarantee uninterrupted access. We may add, modify, or remove features at any time with notice for significant changes.

11. Disclaimers

HyperFokus is provided “as is” without warranties of any kind. It is a productivity tool, not a medical device, and is not a substitute for professional ADHD diagnosis or treatment.

12. Limitation of Liability

To the maximum extent permitted by law, HyperPlanners shall not be liable for indirect, incidental, or consequential damages arising from your use of the app. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Governing Law

These Terms of Service are governed by the laws of the Kingdom of Morocco.
